印尼建筑业受《2017年第2号建筑业法》(建筑业法)管控。外国人可以采用外资企业代表处或外资建筑业企业个体、或外资企业等形式在印尼开展建筑业。印尼建筑业的相关信息如下:

Construction in Indonesia is regulated by Law No. 2 year 2017 concerning Construction Services (Construction Regulation). Foreign contractor may engage in construction services in Indonesia as either a representative office in the form of Kantor Perwakilan Perusahaan Asing (KPPA) or Badan Usaha Jasa Konstruksi Asing (BUJKA), or Foreign Investment Company (PT PMA). Construction in Indonesia can be described as follows:

印尼的建筑企业仅可以在上述两种选择中选择。每个特征又依据其建筑类型进行细分。

Construction companies in Indonesia could only choose between those two choices above. Each characteristic is divided into classifications and sub-classifications according to the types of construction.

外资建筑业企业个体和外资企业仅能够获得B2的大型企业资质,这将使他们面临高风险、高技术性和高成本工作。B2执业者在票面价值上没有限制,且没有行业类别限制,但是禁止涉及小型商业市场的项目。

BUJKA and PT PMA are only allowed to obtain the big qualification which is B2, which entitles them to engage in works that are high risks, high-technology, and high cost. Holders of B2 are allowed to work with infinite nominal value and does not have classification and sub classification limitation, as well as not allowed to work on projects with small business market.

代表处(KPPA)的规定可见《2018年第6号投资协调委员会条例:资本投资优惠和许可证》。

Representative Office (KPPA), which is regulated by Investment Coordinating Board Regulation No. 6 year 2018 concerning Procedure of Capital Investment Facility and License.

代表处是外国企业在印尼设立的代表处,旨在维护其子公司的利益。代表处的活动仅限于:

KPPA is established by foreign company as its representative in Indonesia which aims to take care of the interests of its affiliated companies. The activities of KPPA are limited to:

外资建筑业企业个体 (BUJKA)

外资建筑业企业个体 (BUJKA)的规定可见《2014年第10号公共工程部长条例:BUJKA》。

Badan Usaha Jasa Konstruksi Asing (BUJKA), which is regulated by Ministry of Public of Work Regulation No. 10 year 2014 concerning BUJKA.

外资建筑业企业个体是一家外国建筑公司能在印度尼西亚建立的代表处的类型。因此,建立外资建筑业企业个体的先决条件之一是在印度尼西亚以外的地区设立有建筑公司(母公司)。

BUJKA is a type of representative office that a foreign construction firm can establish in Indonesia. Therefore, one of the prerequisites of setting up a BUJKA is to have an existing construction company outside of Indonesia (Mother Company).

外资企业(PT PMA)

关于建筑领域的外资企业(PT PMA),其相关规定可见《2016年第30号公共工程和住房部长条例:修改<2016年第3号公共工程和住房部长条例:授予外资企业建筑服务许可的技术指导>》*

Foreign Investment Company (PT PMA) in the field of construction, which is regulated by Ministry of Public of Work and Housing Regulation No. 30 year 2016 concerning Amendment of Ministry of Public of Work and Housing Regulation No. 3 year 2016 concerning Technical Instruction for Granting Construction Services Permits for PT PMA.*

* 设立外资企业,外国人无需提前设立代表处。

To establish PT PMA, foreigner does not need to establish KPPA in advance.
